20.00 feet and a 1/2-inch iron rod (found), standing as a corner to said DeBerry and Pitman Consolidated at 301.61 feet; thence leaving said Pitman Consolidated and with said Samuel Livengood, S. 51º 30’11" W. 278.29 feet to the place of beginning, containing 2.84 acres, more or less, as shown on a plat of survey made by Ronald A. Talkington, P.S. No. 876, dated July, 2005, which said plat is recorded in the Office of the Clerk of the County Commission of Preston County, West Virginia, in Deed Book 662, at page 979, and made a part of this description.

And being the same real estate conveyed to Chad D. Lawson and Abby J. Riley, now known as Abby J. Lawson, from Helen G. Livengood, by deed dated the 10th day of October, 2005, of record in the Office of the Clerk of the County Commission of Preston County, West Virginia, in Deed Book 662, at page 977, to which deed reference is here made for all pertinent purposes.

And further being the same real estate conveyed to Brody Lawson by deed to be recorded simultaneously with the recording of this Deed of Trust.

There is excepted and reserved from this conveyance all such coal and mining rights as was heretofore conveyed by David S. Livengood and wife, to Stephen B. Elkins, by Deed dated January 15, 1903, and of record in said Clerk's office in Deed Book 99, at page 278.

This conveyance is made subject to all exceptions, reservations, restrictions, conditions, easements and rights of way as contained in prior deeds of record for this chain of title.

At the time of the execution of the Deed of Trust, this property was reported to have an address of:  162 Cuzzart Mountain Dale Rd, Bruceton Mills, WV 26525.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges.  The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed).  The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in "AS IS" condition.  The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. 

TERMS:  $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN:  In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale.  The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.

APPLICATION FOR A WEST VIRGINIA NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM WATER POLLUTION CONTROL PERMIT

The following has applied for a WV NPDES Water Pollution Control Permit for this facility or activity:

To operate and maintain an existing 35,000 gallon per day sewage collection and treatment system.  These facilities are to serve a population equivalent of approximately 350 persons in the Town of Newburg and environs,  and discharge treated wastewater to Raccoon Creek, via Outlet 001, (approximately 2.7 miles from its mouth) of Three Fork Creek of the Tygart Valley River of the Monongahela River. An antidegradation review has been conducted and Tier 1 protection is provided for the uses specified in Title 47, Series 2, Section 6.  Also, to incorporate the requirements relative to Title 33, Series 2 of the West Virginia Legislative Rules for the processing and disposal of sewage sludge generated by the wastewater treatment plant.  Sewage sludge generated and/or processed at the permittee's facility shall be disposed of by a registered septage hauler.

On the basis of review of the application, the "Water Pollution Control Act (Chapter 22, Article 11-8(a))," and the "West Virginia Legislative Rules," the State of West Virginia will act on the above application.

Any interested person may submit written comments on the draft permit and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice.  Such comments or requests should be addressed to:

The public comment period begins March 08, 2022 and ends April 07, 2022.

Comments received within this period will be considered prior to acting on the permit application.  Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised.  The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit(s).  Interested persons may contact the public information office to obtain further information.
